1. Description of Property, Lease Term, and Occupancy

The Lessors agree to lease to the Lessee the Upstairs Apartment of The Captain Zadoc Brewster House, 4 Bay View Square, Rockland ME, 04841.

The lease term shall begin at 3:00 PM on:

The maximum number of persons occupying the premises under this lease shall be eight.

Should a group exceed the maximum number of people, they may be required to vacate the property without refund.

2. Keys

Keys to the premises will be available at 3:00 PM the day the lease term begins. All rental and security deposit payments must be received prior to the turnover of keys. The Lessors reserve the right to make a charge of $20 each for keys not returned at the termination of the lease.

3. Rent

All rent amounts are subject to a 9% Maine Lodging Tax

With the exception of certain Festivals:

  • A reservation deposit of one-half of the rent amount including 9% Maine Lodging Tax is required to hold the property.
  • The remaining one-half of the rent amount including 9% Main Lodging Tax, the Security Deposit and the Pet Charge (if applicable) are payable thirty days prior to the commencement of the lease.

For the Blues Festival, The Lobster Festival and The Maine Boats & Harbours Show a reservation deposit of the full rent amount including 9% Maine Lodging Tax is required to hold the property. The Security Deposit (if applicable) and the Pet Charge (if applicable) are payable thirty days prior to the commencement of the lease.

  • By Credit Card. We accept Visa, Master Card, Discover & Amex
    • Please click the "Pay Now" button at the bottom of the Home page (you will need to scroll to the bottom)
    • This will take you to our PayPal portal. You do not need a PayPal account.
    • You will need to fill in the amount you are paying in the box at the top.
    • Complete the Credit Card information on the left hand menu on the PayPal portal.
    • Click "Review Order & Continue" and complete the payment to us in the usual way.

Reservations made less than thirty days prior to arrival require full payment and checks should be cashier check or certified check and mailed overnight. PayPal or wire transfer are the preferred methods.

4. Return of Security Deposit

Within fourteen days of the end of the lease term the security deposit, if charged, shall be returned in full, or Lessor will provide Lessee with written notice of any charges (such as telephone calls, lost keys charges, charges for lost or broken property or for other damage caused by and attributable to the lessee, and the cost of extraordinary cleaning of the premises) and return the balance, if any, of the security deposit to Lessee.

5. Breach of Lease

In the event Lessee defaults by failing to pay all payments required under paragraph #3, or permits occupancy by more than permitted number of persons, or violates obligations set forth in Lessee’s obligations in paragraph #8, then all monies paid shall be forfeited by Lessee.

6. Cancellations

All cancellations must be made in writing or by e-mail.

Refunds of monies paid are as follows:

  • More than 30 days before commencement of the lease and after a reservation deposit has been made:
    • The reservation deposit shall be forfeited unless the premises can be re-rented for the same time period and at the same rate, then Lessee’s deposit shall be returned in full. At the Lessor’s discretion a pro-rata refund may be made if the premises are re-rented for less than the same time period or rate.
  • 30 days or less before commencement of the lease:
    • The full rental monies shall be forfeited unless the premises can be re-rented for the same time period and at the same rate, then Lessee’s rental monies shall be returned in full. At the Lessor’s discretion a pro-rata refund may be made if the premises are re-rented for less than the same time period or rate.

7. Lessor’s Obligations

The property will be delivered cleaned, furnished, and with utilities provided at no additional cost to Lessee. Lessor warrants that the premises and all appliances, heating, plumbing, and electrical systems are in working order and that the cost of repairs will be borne by the Lessor, unless due to negligence of the Lessee. Lessor’s responsibility is to provide housekeeping prior to your arrival and following your departure, however, housekeeping is not provided during rental period.

8. Lessee’s Obligations

Lessee shall use the premises for residential purposes only and agrees to keep the premises in as good repair and condition as found, reasonable wear and tear excepted. Lessee agrees to yield up the premises at the termination of the lease term and return the keys. Lessee agrees to be responsible for any property broken or lost, and for any extraordinary cleaning required to return the premises to the condition they were in prior to Lessee’s occupancy, and agrees that such costs may be deducted from the security deposit. Lessee agrees to permit the Lessor to enter the premises to perform necessary repairs and/or maintenance, or show a prospective buyer or renter, if notified 24 hours in advance. Lessee may peaceably hold and enjoy the premises without interruption during the period of the lease.

9. Pets

Pets are allowed on the premises provided the Lessee has agreed to a Pet Agreement and, if required, paid a Pet Charge.

10. Other

No sublet is permitted.

If the premises should be destroyed by fire or become uninhabitable prior to or during the lease period (assuming no negligence on the part of the Lessee), prorated rent shall be returned to Lessee.

Smoking is not permitted within the residence.

11. Indemnification

Lessee agrees to indemnify and save Lessor and its employees, free and harmless for any liabilities, or any loss or damage whatsoever arising from, related to or in connection with rental of the premises including but not limited to any claim or liability for personal injury or damage or loss of property which is made, incurred or sustained by Lessee or guests of Lessee.

This agreement is the whole agreement between Lessor and Lessee, and all prior agreements, understandings, promises, statements, whether by Lessor or Lessee is merged herein. This agreement may be modified only by written amendment, signed by both parties.

This agreement shall be interpreted under the laws of the State of Maine.
